And it is firmly established by explicit text and by unanimous consensus that, once the People of the Book and the Magians hand over the jizya in person while humbled, it becomes unlawful to fight them.⦗1⦘
Yet a number of scholars have claimed that this verse—His saying, “Fight in the path of Allah those who fight you” (Q 2:190)—was later abrogated.
Abu al-Faraj⦗2⦘ said: The scholars have differed: was this verse abrogated, or
= And this is more pleasing to Allah than killing them.
(1) Shaykh al-Islam Ibn Taymiyya writes in Minhaj al-Sunnah, 8/514: “When Allah commanded the fighting of the ahl al-kitab (People of the Book) until they pay the jizya (tribute) directly while humbled, the Prophet ﷺ also accepted the jizya from the majus (Magians). The Muslims therefore concurred that it may be taken from both the People of the Book and the Magians. As for all other unbelievers, the scholars have held three opinions: (a) they must all be fought until they pay the jizya in a state of subjugation if they do not accept Islam—this is the view of Malik; (b) the Arab polytheists are excepted from this ruling—this is the position of Abu Hanifa and, in one narration, of Ahmad; (c) the verse applies exclusively to the People of the Book and those who possess a quasi-scripture—this is the view of al-Shafi‘i and, in another narration, of Ahmad. The first and second opinions are identical in substance.”
