defending his religion is a martyr, and whoever is killed defending his honor is a martyr.” (1)(2).
If fleas (3)(4) or lice (5)(6) bite him, he may brush them off or kill them, and no penalty is due—although removing them is easier than killing them (7). The same ruling applies to any other animal that comes at him: he is instructed not to kill it, even if that species is itself unlawful to hunt, such as a lion or a cheetah (8). Should he nevertheless kill it, no expiation is required of him according to the stronger opinion.
(1) The words within brackets are missing in manuscript D.
(2) Reported by Ahmad, no. 1652; Abu Dawud, no. 4772; al-Tirmidhi, no. 1421, who graded it hasan sahih; al-Nasai, no. 4095; and Ibn Majah, no. 2580, on the authority of Said ibn Zayd, marfu. Declared authentic by al-Albani.
(3) In manuscript B the reading is: “its bite (qarsuh).”
(4) According to the school, killing fleas is always permissible; see al-Insaf, 3/468.
(5) Manuscripts B, C, and D add: “and lice.”
(6) The school holds that killing lice is forbidden, yet if one does so no expiation is required; see al-Insaf, 3/486.
(7) See al-Furu, 5/4070; Ikhtiyarat al-Baali, p. 174.
(8) The preferred view is that it is recommended to kill any animal whose nature is to harm—even if no harm has yet occurred—such as the lion, tiger, wolf, leopard, and the like; see Kashshaf al-Qina, 2/439. Shaykh al-Islam (Ibn Taymiyya) states in Sharh al-Umda, 4/581: “Another report says it should be killed only if it actually attacks; if it does not, it should not be killed … This report is sounder, God willing,” after which he presents seven arguments supporting it.
