Manāsik al-ḤajjIbn Taimiya

The Muslims (1) never disagreed over the existence of a third sanctuary (2) except with regard to Wajj (3) – a valley in Ta’if (4). A minority consider it a sanctuary, but the majority do not (5).

A pilgrim in the state of ihram may kill creatures that customarily harm people – such as snakes, mice, scorpions (6), crows, and the vicious dog (7).

He may likewise repel anything that harms him, whether human or beast. If someone attacks him and cannot be driven off except by fighting, he may fight back, for the Prophet ﷺ said (8): “Whoever [is killed defending his wealth is a martyr, whoever is killed defending his blood is a martyr, and whoever] (9) is killed…"

(1) In manuscript B: “wa-lamma tanazaʿu” (“and when they disputed”). (2) In B: “thalath” (“three”). (3) The phrase “illa fi Wajj” (“except in Wajj”) is missing in D; in C it reads “illa Wajjan” (“except Wajj”), while A and B have “illa fi Marah” (“except in Marah”). (4) In D: “fi al-Taʾif” (“in Taʾif”). (5) The Hanafis and Shafiʿis consider Wadi Wajj to be a sanctuary whose game is inviolable, whereas the Hanbalis do not. See: al-Tajrid by al-Quduri 4/2122; al-Majmuʿ 7/477; al-Insaf 3/563. (6) In C and D: “wa-l-ʿaqrab wa-l-faʾrah” (“and the scorpion and the mouse”). (7) According to the Hanbali school, the preferred opinion is that killing it is recommended; cf. al-Insaf 3/488. (8) In A and B: “qala al-nabi sallallahu ʿalayhi wa-sallam” (“the Prophet, peace be upon him, said”). (9) The text enclosed in brackets is absent from A and B.
