nor may he wear anything that is treated like trousers, such as the tabbān (1) and similar garments.

He may, however, tie whatever truly needs to be tied, like the izār and the money belt for his provisions (2).

The cloak (3) does not need a knot (4); therefore he should not fasten it. If he does need to secure it, the matter is disputed (5), and the view that appears stronger is that it is permissible in that case.

As for whether the prohibition on tying it (6) is one of mere dislike or of outright unlawfulness, this too is a point of contention, and it is not

(1) Al-Sihah, 5/2086: “al-tubban—with a ḍammah on the first consonant and a shaddah—designates a very short pair of trousers, roughly one span in length, that covers only the private parts and was commonly worn by sailors.” (2) al-himyan (with kasrah on the h): a pouch or money-bag tied around the waist; pl. humayyan. The word is of foreign origin. See: Lisan al-Arab 15/364; al-Misbah al-Munir 2/641. (3) The phrase “wa-himyanu al-nafaqati wa-l-rida’ ” here reads in manuscript D: “wa-himyanu al-rida’ ”. (4) Manuscripts C and D read: “ʿaqdahu”. (5) According to the Maliki, Shafiʿi, and Hanbali schools, knotting the upper garment (rida’) while in ihram is forbidden; doing so obliges a compensatory offering (fidyah). The Hanafi school considers it merely reprehensible (makruh). Ibn Taymiyyah, and as reported by al-Baʿli in his Ikhtiyarat, permits tying the rida’ without restriction, whether out of necessity or otherwise. Al-Baʿli states (p. 174): “It is permissible to knot the rida’ during ihram, and no fidyah is due.” He also notes in al-Furuʿ 5/428: “Our Shaykh said: and the rida’ for a need.” See further: al-Bunayyah Sharh al-Hidayah 4/168; As’hal al-Madarik 1/481; al-Majmuʿ 7/255; Sharh al-Muntaha 1/540. (6) The phrase “min ʿaqdihi” appears in manuscript D as “minhu”.
