Jilbab al-Marah al-Muslimah fi al-Kitab wa al-SunnahNasir al-Din al-Albani

2- Abu ‘Abd Allah Muhammad ibn Ahmad ibn Musa al-Qadi said:

I was present at the court of Judge Musa ibn Ishaq in Rayy in the year 286 AH. A woman came forward, and her guardian claimed from her husband a five-hundred-dinar dower. The husband denied the claim, whereupon the judge said, “Produce your witnesses.” He answered, “I have brought them.” One of the witnesses asked permission to look at the woman so that he could point her out in his testimony. The witness rose and said to the woman, “Stand up.” At that the husband said:

= This conclusion accords with the way the classical lexicographers define the word wajh (face). Al-Asbahani writes in his Mufradat: “The original meaning of wajh is the bodily organ; since the face is the first part that confronts you and the noblest of the body’s exterior, the term came to denote whatever is foremost, most honored, or the starting point of a thing.” On that basis, the remark of Ustadh Mawdudi in his Taqib (p. 21)—“The face is not limited to the facial disc but, according to common usage, also includes the ears”—has no foundation. It contradicts the jurists’ definition cited above and runs counter to the Prophet’s explicit statement: “The two ears are part of the head.” Al-Tabarani reports this hadith from Ibn Abbas with a sound chain, and I have cited many corroborating narrations in Silsilat al-Ahadith al-Sahihah, no. 40. 2. Al-Khatib, Tarikh Baghdad, 13/53.
