Taysīr al-ʿAllāmAbd Allah al-Bassam

6- Interpreting this noble verse in light of the present lawsuit is an interpretation that is traced back to the Prophet ﷺ; accordingly, the ḥadith serves to clarify the verse and spell out its intent.

7- In brief, the verse means that whoever trades in his oaths—those sworn by Allah and His Messenger—and breaks the solemn covenant of faith for the fleeting enjoyments of this worldly life has made a losing bargain. Even if he were given the whole world in exchange, the price is paltry. His recompense is to be deprived of any portion in the Hereafter, to be banished from words of kindness and mercy, and to be denied the compassionate gaze of the All-Generous. He will remain steeped in his sins and filth, never to be purified, nor will he be left alone, for a painful punishment awaits him. We seek Allah’s protection for ourselves, our parents, relatives, teachers, and all our Muslim brothers. Āmīn.

The Sixth Ḥadith
Al-Ashʿath ibn Qays reported: “There was a dispute between me and another man over a well, so we brought our case before the Messenger of Allah ﷺ. The Messenger of Allah ﷺ said, ‘Either you produce two witnesses, or he must swear an oath.’ I replied, ‘If so, he will swear and not care in the least.’ The Messenger of Allah ﷺ then said, ‘Whoever swears a persevering oath (yamīn ṣabr) by which he seizes the wealth of a fellow Muslim while acting wickedly will meet Allah while Allah is angry with him.’”

Points derived from the ḥadith
1- The principle that “evidence rests with the claimant and the oath with the one who denies” is the Islamic rule in litigation; it is part of the “decisive speech” mentioned in the verse, “We granted him wisdom and decisive speech.”

2- A right is established by the testimony of two witnesses. If the claimant lacks evidence, the defendant is required to take an oath.

3- The false, plunging oath (al-yamīn al-ghamūs)—an oath sworn to usurp another’s right—is forbidden and counts among the major sins, exposing its perpetrator to Allah’s wrath and punishment.

4- A judge’s ruling settles only the outward dispute; the inner reality remains. Therefore what is awarded by the court is not lawful for the recipient unless it was in fact permissible for him.
