Second benefit:
Marrying a Jewish or Christian woman is lawful, as affirmed by the verse in al-Māʾidah, and this is the position of the great majority of early and later scholars, including the four Imams.
If someone objects, saying, “But the Quran brands them as polytheists in the verse, ‘They have taken their rabbis and monks as lords apart from Allah…,’” the reply is that original Judaism and Christianity contain no polytheism. Whenever the Scripture refers to them as having committed shirk, it is on account of later innovations they introduced. In its essence their religion was to follow the revealed books that called to monotheism, not to polytheism. This is the end of the quotation from Shaykh al-Islām Ibn Taymiyyah.

The criterion for assessing such conditions is found in the Prophet’s ﷺ statement: “Muslims are bound by their conditions, except a condition that makes the lawful unlawful or the unlawful lawful.” There is no difference whether the condition is stipulated before or at the time of the contract.
Hadith One
ʿUqbah ibn ʿĀmir reported that the Messenger of Allah ﷺ said, “The conditions most entitled to your fulfilment are those by which you have made private parts lawful to yourselves.”
Overall meaning:
Each spouse has motives and aims when entering into marriage. Accordingly, one may set conditions upon the other so as to safeguard those interests, in addition to the conditions that naturally arise from the very contract of marriage.
Because marital conditions are held in high esteem and carry great weight—for by them sexual relations become lawful—the wise and just Lawgiver exhorted the spouses to honour them, declaring that the condition most deserving of fulfilment and highest in priority is the one through which intimacy has been lawfully obtained and the bride’s person granted.
Points derived from the hadith:
1- The obligation to fulfil any condition that either spouse undertakes toward the other, such as stipulating an increased
