Taysīr al-ʿAllāmAbd Allah al-Bassam

Points derived from the hadith:

  1. Emigration (hijrah) from Mecca to any other land has ended, for—praise be to Allah—Mecca is now permanently an Islamic land. Emigration from elsewhere, however, remains obligatory for anyone who cannot practise his religion where he lives.
  2. Jihad continues to be incumbent: when the opportunity exists participation is obligatory, and when it does not the intention for it must still be present. A sound intention is an essential pillar for the acceptance of all deeds; everything revolves around it.
  3. His words, “And if you are summoned to set out, then go forth,” mean: if you are called to jihad, answer the call. Thus it is compulsory for a Muslim to march when the ruler commands him to fight an enemy, whether the summons is general or directed to specific individuals. Whoever the ruler designates must go.
  4. Fighting in Mecca is prohibited; it will remain unlawful for anyone until the Day of Resurrection.
  5. The temporary suspension of this prohibition for the Prophet ﷺ was one of his unique privileges: it was permitted to him for only a single hour, after which its sanctity returned exactly as it had been since the creation of the heavens and the earth.
  6. Cutting the thorns that grow within its Sanctuary is forbidden, and cutting non-thorny trees or green herbage is even more emphatically forbidden.
  7. It is likewise unlawful to scare away its game; to confine or kill such animals is even more strictly prohibited. “Game” refers to wild, edible animals by nature.
  8. It is forbidden to take a lost item (luqta) found within the Sanctuary except for the person who picks it up solely to make continual public announcement of it.
  9. Idhkhir is exempted from the general ban on herbage because of the community’s great need for it; it may therefore be gathered whether fresh or dry.
  10. Part of the Sunnah is conveyed through an understanding that Allah instils in His Prophet ﷺ, as He says: “We have sent down to you the Reminder so that you may clarify to people what has been revealed to them” (Qur’an 16:44).
  11. A brief pause that is not regarded as a break in speech does not harm the linkage between an exception and the rule from which it is excepted.
  12. The Prophet ﷺ conquered Mecca by force (ʿanwatan); its detailed treatment will follow, Allah willing.

Differences among the scholars:
The scholars unanimously agree that it is forbidden to cut the wild trees and natural herbage of the Sanctuary that people have not planted. They also agree that it is permissible to gather idhkhir and vegetation cultivated by people—such as crops and legumes—based on the sound hadiths cited above and others.
They differ regarding trees planted by people. The majority deem it permissible to cut them, likening them to cultivated crops. The Shafiʿis hold it forbidden, following the general import of the hadith, and Shaykh al-Muwaffaq Ibn Qudāmah leaned toward this view in al-Mughnī.
