(continuation) As for the second report, its flaw is the unknown status of Khalid b. Abi Nuf, for only two narrators transmitted from him: Mutarrif—namely Ibn Turayf—and Yunus b. Abi Ishaq. He is therefore classed among those whose reliability is unknown, and Ibn Hibban’s endorsement does not assist here, given his well-known leniency in declaring narrators trustworthy. From this it becomes clear that the two reports cannot be used as legal proof, and this is probably why al-Shafi‘i retracted his earlier (qadim) opinion. In his later (jadid) position he said that a follower (mu’tamm) does not pronounce Amin aloud. His wording in al-Umm (1/65) is: “When the imam finishes reciting Umm al-Quran (al-Fatihah) he says: ‘Amin,’ raising his voice so that those behind him may follow. When he says it, they say it and let themselves hear it; but I dislike their saying it aloud—yet if they do, there is no sin upon them.”
This, God willing, is the view we adopt, for the reasons set out above. Moreover, none of the transmitters who reported that the Prophet ﷺ said Amin aloud mentioned that the Companions said it aloud behind him. Had they done so, the fact would surely have reached us, especially since raising the voice in this context is contrary to the default rule. Allah says (7:55): “Call upon your Lord with humility and privately; indeed He does not love the transgressors.” One may depart from this principle only on the basis of a sound proof. We have departed from it concerning the imam’s audibility, because that is firmly established from the Prophet ﷺ; everything else remains upon the original rule. Allah is the granter of success.
After writing the above I noticed that Ibn Hazm cites the report in al-Muhalla (3/364) via Abd al-Razzaq, from Ibn Jurayj, who said:
“I asked Ata: Did Ibn al-Zubayr say Amin after Umm al-Quran?” He replied, “Yes, and those behind him also said Amin, such that the mosque would roar.” Ata added: “Abu Hurayra would enter the mosque after the imam had already begun and call out to him, ‘Do not precede me with Amin.’”
