a prayer. In our view, however, the imam leads the people in two rakʿahs, then offers supplication and turns his cloak inside-out… and so forth.
- Take ʿIṣām ibn Yūsuf al-Balkhī—one of Imam Muhammad’s disciples (1) and a close companion of Imam Abu Yusuf (2). “He would frequently give legal verdicts contrary to Abu Hanifah’s position because he did not know the latter’s evidence, and when another proof became clear to him he would follow it.” (3) For that reason “he used to raise his hands when going into bowing and when rising from it,” (4) exactly as the mass-transmitted Sunnah prescribes.

(4) Al-Fawaid, p. 116. The author then observes—aptly—: “I say: From this it is clear that the report attributed to Mak-hul from Abu Hanifah—‘Whoever raises his hands in prayer, his prayer is invalid’—is groundless, a report that deceived Amir Katib al-Itqani (as mentioned in his biography). Issam ibn Yusuf was a close disciple of Abu Yusuf and he himself raised his hands; had that report possessed any authenticity, Abu Yusuf and Issam would certainly have known of it.
“It also follows that if a Hanafi abandons his Imam’s position on a particular issue because the contrary evidence is stronger, he does not thereby leave the fold of taqlid; rather, this is taqlid itself, merely appearing as its abandonment. Do you not see that Issam ibn Yusuf left Abu Hanifah’s view of not raising the hands, yet he is still counted among the Hanafis?
“We therefore complain to Allah about the ignoramuses of our time who censure anyone who departs from his Imam’s opinion in a single matter on account of stronger proof and expel him from the Imam’s following. Their attitude is unsurprising, for they are lay-people; the real astonishment is at those who pretend to be scholars and walk about like cattle!”
