and the Sunnah, then accept it; and whatever does not agree with the Book and the Sunnah, then leave it. (1)
2- “There is no one—after the Prophet ﷺ—whose every statement must be taken without exception; that applies only to the Prophet ﷺ.” (2)
3- Ibn Wahb said:
“I heard Mālik being asked about running one’s fingers between the toes during wuḍūʾ. He replied, ‘That is not required of the people.’
I waited until the crowd had thinned out, then I said to him, ‘We have a Sunnah concerning that.’
He asked, ‘And what is it?’
I said, ‘Al-Layth ibn Saʿd, Ibn Luhayʿah, and ʿAmr ibn al-Ḥārith narrated to us from Yazīd ibn ʿAmr al-Maʿāfirī, from Abū ʿAbd al-Raḥmān al-Hubulī, from al-Mustawrid ibn Shaddād al-Qurashī, who said:’
(1) Ibn ʿAbd al-Barr, al-Jamiʿ, 2/32; quoted from him by Ibn Hazm, al-Ihkam fi Usul al-Ahkam, 6/149; likewise by al-Fulani, p. 72.
(2) The prevalent view among later scholars is that this maxim is attributable to Malik, and Ibn ʿAbd al-Hadi judged the attribution sound in Irshad al-Salik, 1/227. Ibn ʿAbd al-Barr records it in al-Jamiʿ, 2/91, and Ibn Hazm in al-Ihkam fi Usul al-Ahkam, 6/145 and 179, as the wording of al-Hakam ibn ʿUtayba and Mujahid. Taqi al-Din al-Subki cites it in al-Fatawa, 1/148, as a saying of Ibn ʿAbbas—marveling at its eloquence—then remarks: “Mujahid took this phrase from Ibn ʿAbbas, Malik adopted it from both of them, and it thereafter became famous in his name.”
I would add that Imam Ahmad also adopted it, for Abu Dawud states in Masail al-Imam Ahmad, p. 276: “I heard Ahmad say: ‘Every person’s view may be accepted or rejected—except that of the Prophet.’”
