which will be discussed under hadith 3316, thereby adding further strength to the hadith. *
- “Whoever passes by a walled garden should eat, but not carry anything away.”
Al-Tirmidhī, Ibn Mājah, and Aḥmad, in Masāʾil Abī Dāwūd ʿan Aḥmad (p. 304), transmitted it through Yaḥyā ibn Sulaym, from ʿAbd Allāh, from Nāfiʿ, from Ibn ʿUmar, from the Prophet, peace and blessings be upon him, who said ... and he then cited it. Al-Tirmidhī said:
“This is a singular hadith; we know it only through the hadith of Yaḥyā ibn Sulaym.”
I say: Imam Aḥmad likewise declared it defective, as Abū Dāwūd indicated by saying:
“I mentioned to Aḥmad the hadith of Yaḥyā ibn Sulaym ... and he rebuked me, considering the hadith weak.”
I say: However, I found a supporting narration for it in the hadith of Ibn ʿAmr. Ibn Abī Shaybah said in al-Muṣannaf (6/85/356): Wakīʿ narrated to us from Hishām ibn Saʿd, from ʿAmr ibn Shuʿayb, who said: The Messenger of Allah, peace and blessings be upon him, said ... and he cited it verbatim.
This has a double break, but it has also been narrated with a continuous chain. Imam Aḥmad said in al-Musnad (2/224): Ḥammād ibn Khālid narrated to us; Hishām ibn Saʿd narrated to us from ʿAmr ibn Shuʿayb, from his father, from his grandfather, ʿAbd Allāh ibn ʿAmr: The Messenger of Allah, peace and blessings be upon him, was asked about a man entering a walled garden. He said:
“He may eat, provided that he does not take anything away in his garment.”
This is a continuous, good chain of transmission.
Muḥammad ibn Isḥāq also followed him in narrating it from ʿAmr ibn Shuʿayb, with similar wording.
