“…He narrates from Ibn ʿUmar; Qatādah narrates from him; and Ḥakīm also heard from ʿUthmān ibn ʿAffān.”
I found that one of the ḥadith scholars had jotted in the margin:
“Al-ʿUjaylī: A Basran Successor, trustworthy.”
Ibn Ḥazm then quoted—on the authority of Saʿīd ibn Jubayr—that a man said to Ibn ʿAbbās:
“I have married a beautiful cousin of mine and consummated the marriage during Ramaḍān. May my father and mother be your ransom—do I have any permission to kiss her?”
Ibn ʿAbbās replied, “Can you control yourself?” He said, “Yes.” Ibn ʿAbbās said, “Then kiss her.”
The man continued, “May my father and mother be your ransom—do I have any permission to engage in mubāsharah (physical intimacy short of intercourse) with her?” Ibn ʿAbbās again asked, “Can you control yourself?” He replied, “Yes.” He said, “Then engage in mubāsharah with her.”
He asked, “May I touch her private part with my hand?” Ibn ʿAbbās said, “Can you control yourself?” He answered, “Yes.” Ibn ʿAbbās said, “Then touch it.”
Ibn Ḥazm commented, “This is the soundest chain from Ibn ʿAbbās.”
He added, “Through sound chains it is reported from Saʿd ibn Abī Waqqāṣ that he was asked, ‘Do you kiss while fasting?’ He said, ‘Yes, and I grasp her private parts.’ It is also narrated from ʿAmr ibn Sharḥabīl that Ibn Masʿūd used to engage in mubāsharah with his wife at midday while he was fasting. This is the soundest chain from Ibn Masʿūd.”
I say: Ibn Abī Shaybah recorded this narration of Ibn Masʿūd (2/167/2) with a chain that fulfils the criteria of both al-Bukhārī and Muslim, and he likewise recorded the report of Saʿd with the wording: “He said, ‘Yes, and I take hold of her private parts.’”
