2501 — “Beware of sitting in the public thoroughfares (in another narration: the roads). If you must do so, then give the road its due.” It was asked, “What is its due?” He said, “Lowering the gaze, returning greetings of peace, and guiding the lost.”
Reported by al-Tahawi in Mishkil al-Athar (1/58), and by al-Bazzar in his Musnad (2/425/2018)—Kashf al-Astar—through Muhammad ibn al-Muthanna and Yazid ibn Sinan, who said: Abdullah ibn Sinan narrated to us; Abdullah ibn al-Mubarak narrated to us, from Jarir ibn Hazim, from Ishaq ibn Suwayd, from Ibn Hujayrah, from Umar, that the Messenger of Allah, may Allah bless him and grant him peace, said this. Al-Bazzar said: “We know of no one who transmitted it with a continuous chain to the Prophet except Jarir, and no one who narrated it from him except Ibn al-Mubarak. Hammad ibn Zayd narrated it from Ishaq ibn Suwayd as a mursal report.”
This is how it appears there. Al-Tahawi, however, transmitted it through Hajjaj ibn Minhal: Hammad ibn Salamah narrated to us, from Ishaq ibn Suwayd, from Yahya ibn Ya'mur, that the Prophet, may Allah bless him and grant him peace, then mentioned the hadith. Al-Tahawi said: “The chain of transmission is interrupted.” I say: That is, it is mursal, and this is closer to what is correct, as al-Daraqutni stated in al-'Ilal (2/251). Ishaq ibn Suwayd narrated from both Hammads, so it is possible that both of them narrated it from him as a mursal report. It should then be examined whether the mention of Yahya ibn Ya'mur was omitted from the version in Kashf al-Astar or by its copyist. (1)
