to have been fornication, as indicated by Allah’s saying: “And the fornicatress—none marries her but a fornicator or a polytheist.” (1)
2445 — “Do not kill one another [nor should any of you strike another]; and when you cast at the Jamarah, cast with pebbles like those used for flicking.”
It was recorded by Abu Dawud (1966), al-Tayalisi (1660), and Ahmad (3/503 and 6/376, 379), through Yazid ibn Abi Ziyad, who said: Sulayman ibn ʿAmr ibn al-Ahwas informed us from his mother, who said:
“I saw the Messenger of Allah, peace and blessings be upon him, casting at the Jamarah in the middle of the valley while riding, saying the takbir with each pebble. A man was behind him, shielding him. I asked about the man, and they said: ‘Al-Fadl ibn al-ʿAbbas.’ The people crowded together, so the Prophet, peace and blessings be upon him, said: …” Then he mentioned it.
The additional wording is from Ahmad. The words in square brackets were omitted there, and I have supplied them from al-Ziyadah ʿala al-Jamiʿ al-Saghir. He also attributed it, with the additional wording, to Abu Dawud and Ibn Majah!
I say: This is a weak chain of transmission. This Sulayman ibn ʿAmr is unknown in status; no one declared him reliable except Ibn Hibban, and no one narrated from him besides this Yazid and Shabib ibn Gharqadah. Yazid ibn Abi Ziyad—the Hashimite client—is weak on account of his memory. However, the hadith is good, for it has two other routes in al-Musnad. The first is through al-Hajjaj ibn Artah, from Abu Yazid, the client of ʿAbdullah ibn al-Harith, from Umm Jundab al-Azdiyyah, with similar wording but without the additional phrase. This Abu Yazid is not known; al-Hafiz mentioned him in al-Taʿjil on account of this narration, without adding anything further. The other is through Layth, from ʿAbdullah ibn Shaddad, from her, attributed to the Prophet, peace and blessings be upon him, with the wording:
“O people! Maintain calmness and dignity, and use pebbles like those used for flicking.”
