I say: Even if his hadith is not good in itself, it is at least good by virtue of corroboration, since Maṭar al-Warrāq corroborated him. This latter wording was also narrated by Ayyūb from ʿAmr ibn Shuʿayb as follows: “It is not lawful to combine a loan with a sale, nor to stipulate two conditions in a sale, nor to sell what you do not possess.” Al-Nasāʾī narrated it (2/225).
2185 — “Water is not rendered ritually impure by janābah (major ritual impurity).”
Ibn Saʿd (8/137) and Aḥmad (6/330) narrated it through Shurayk, from Sammāk, from ʿIkrimah, from Ibn ʿAbbās, from Maymūnah, who said: “The Messenger of Allah and I became junub, and I performed ghusl from a basin, leaving some water in it. Then the Prophet came and performed ghusl from it. I said, ‘I have already performed ghusl from it.’ He replied with the above words.”
I say: The narrators in this chain are trustworthy, except for Shurayk—namely, Ibn ʿAbd Allāh the judge—who had poor retention. Moreover, he transmitted its chain inconsistently: on one occasion, he narrated it in this manner, making it a report from Maymūnah herself; and on another, he said: “Ibn ʿAbbās said: ‘The Prophet and Maymūnah became junub, and Maymūnah performed ghusl in a basin ...’” Aḥmad narrated this version (1/337).
Thus, he made it a report from Ibn ʿAbbās rather than from Maymūnah. This is the correct version, since Sufyān and Abū al-Aḥwaṣ corroborated him in it, as narrated by Abū Dāwūd and others, as documented in Ṣaḥīḥ Abī Dāwūd (61).
Al-Dāraquṭnī narrated (p. 42), through Abū ʿUmar al-Māzinī, Ḥafṣ ibn ʿUmar, from Sulaym ibn Ḥayyān, from Saʿīd ibn Mīnā, from Jābir ibn ʿAbd Allāh, in a report attributed to the Prophet with the same wording, adding: “Nor is the earth rendered ritually impure by janābah, nor is a garment rendered ritually impure by janābah.”
