It is also corroborated by what Ahmad reported (2/202, 224, and 225), through Hanan ibn Kharijah, from Abdullah ibn Amr, who said: A man came to the Prophet, peace and blessings be upon him, and said, “O Messenger of Allah, tell us about the garments of the people of Paradise: are they created or woven?” Some of the people laughed, so the Messenger of Allah, peace and blessings be upon him, said, “Why do you laugh at an ignorant man asking a learned man?” Then the Messenger of Allah, peace and blessings be upon him, lowered his head, and then said, “Where is the questioner?” He replied, “Here I am, O Messenger of Allah!” He said, “No; rather, the fruits of Paradise split open to reveal them”—three times.
1986 — “Intentional killing entails retribution, while accidental killing entails blood money.”
Al-Tabarani reported it in al-Kabir as a marfuʿ hadith of Amr ibn Hazm. Al-Haythami said in al-Majmaʿ (6/286): “Its chain contains عمران ibn Abi al-Fadl, who is weak.” Al-Manawi concurred with him.
I say: Rather, it is an authentic hadith. Al-Daraqutni reported it in his Sunan (p. 328) through several chains from Amr ibn Dinar, from Ibn Abbas, as a marfuʿ hadith with various wordings. The closest to the wording of the heading is: “Intentional killing entails retribution, while accidental killing entails blood money, with no retribution for it …” The hadith is cited in al-Mishkah (3478) and, I believe, also in al-Irwaʾ. The first half of it has another supporting report from Uthman ibn Affan, as a marfuʿ hadith with similar wording. Al-Nasaʾi (2/169) and Ahmad (1/63) reported it through Matar al-Warraq, from Nafiʿ, from Ibn Umar, from him. Its chain is good as corroborating evidence.
Retaliation means legal retribution: executing the killer in place of the victim.
