- “Maintenance and housing are due to a woman only if her husband has the right to take her back.”
Al-Nasāʾī recorded it (2/96) through Saʿīd ibn Yazīd al-Aḥmasī, and Aḥmad (6/373, 415, 416, and 417) through Mujālid ibn Saʿīd. Both narrated from al-Shaʿbī, who said: Fāṭimah bint Qays told me:
“I came to the Prophet (peace and blessings be upon him) and said, ‘I am from the family of Khālid, and my husband, so-and-so, has sent me word divorcing me. I asked his family for maintenance and housing, but they refused me.’ They said, ‘Messenger of Allah, he has sent her word that he has divorced her three times.’” She said: The Messenger of Allah (peace and blessings be upon him) then said …
He then cited it. The wording is that of the first source, and its chain of transmission is authentic. A number of narrators also corroborated al-Shaʿbī, conveying its meaning in the two Ṣaḥīḥs and elsewhere, with differing wordings. I have documented some of them in al-Rawḍ al-Naḍīr (836), where I also mentioned another corroborating report from al-Shaʿbī with the same chain. Al-Dāraquṭnī recorded it with a good chain of transmission.
- “Witr is only at night.”
Al-Ṭabarānī recorded it in al-Muʿjam al-Kabīr (no. 891), from Khālid ibn Abī Karīmah, who said: Muʿāwiyah ibn Qurrah informed us, from al-Agharr al-Muzanī, that a man came to the Messenger of Allah (peace and blessings be upon him) and said, “O Prophet of Allah, morning has come and I have not performed Witr.” He replied with the above wording. The man said, “O Prophet of Allah, morning has come and I have not performed Witr.” He said, “Then perform Witr.”
I say: This chain of transmission is good, at least as corroborative evidence. Concerning Khālid ibn Abī Karīmah, al-Ḥāfiẓ said:
