“Two conditions in a sale: that one says, ‘I sell you this commodity for such-and-such if payment is due in one month, and for such-and-such if it is due in two months.’” He then gave the heading for the hadith of Abu Hurayrah: “Two sales in a single sale: that one says, ‘I sell you this commodity for one hundred dirhams in cash and for two hundred dirhams on credit.’”
“Profit from that for which one does not bear liability”: “It means that a person sells an item which he has bought but not yet taken possession of. It remains under the liability of the first seller, not under his own liability. Thus, he may not sell it until he takes possession of it, whereupon it comes under his liability.” This was stated by al-Khattabi in Ma‘alim al-Sunan (5/144).
“Selling what is not in your possession”: Al-Khattabi said: “What is meant is selling a specified item, as distinct from a sale by description. Do you not see that he permitted salam contracts with deferred delivery dates, though this is the sale of something the seller does not presently possess? Rather, he prohibited the sale of what the seller does not possess because of the uncertainty involved, such as when one sells his runaway slave or his stray camel.”
1213 — “When a servant stands to pray, an angel comes to him and stands behind him, listening to the Quran and drawing near. He continues to listen and draw near until he places his mouth upon his mouth. Thus, he does not recite a single verse except that it is within the angel.”
Al-Bayhaqi recorded it in al-Sunan al-Kubra (1/38), and al-Diya’ in al-Mukhtarah (1/201), through the route of Khalid, from al-Hasan ibn ‘Ubayd Allah, from Sa‘d ibn ‘Ubaydah, from Abu ‘Abd al-Rahman al-Sulami, from ‘Ali, who said: “We were commanded to use the tooth-stick,” and then mentioned it. Its apparent form indicates that it is attributed to the Companion, though it may be attributed to the Prophet. This is supported by another narration recorded by him through the route of Shu‘bah, from al-Hasan ibn ‘Ubayd Allah, with the same chain, as a report attributed to the Companion; he added at its end: “He said: I asked, ‘Is it from the Prophet, peace and blessings be upon him?’ He said: ‘Yes, if Allah wills.’” Al-Asbahani likewise recorded it in al-Targhib (197/1).
Fudayl ibn Sulayman also corroborated him from al-Hasan ibn ‘Ubayd Allah, with the wording, from ‘Ali: “He commanded us to use the tooth-stick and said: The Prophet, peace and blessings be upon him, said:”
