Minhaj as-SunnahIbn Taimiya

but the majority of jurists do not hold this view. As for Ahmad, it is reported that he regarded the report as weak (1) and therefore did not adopt it, although it is also said that he did. Among the imams, Ahmad made the broadest use of drawing lots. He also adopted Ali’s judgment in the case of the lion pit (2), the report of which is more firmly established than this one. It was narrated by Simāk ibn Harb, and Ahmad adopted it (3). As for the other three imams, either neither of these reports had reached them, or the reports had reached them but had not been established as authentic in their judgment. Ahmad possessed a degree of knowledge of transmitted reports, and of how to distinguish the sound among them from the unsound, that others did not possess.

(1) M, S, and B read: “because of the weakness [of the report].” (2) N reads *al-rubbya*; M, *baytihi* (“his house”); and S and B, *al-rutba* (“the rank”). The correct reading is the one I have printed. A *zubya*, as Shaykh Ahmad Shākir—may Allah have mercy on him—explained, is a pit dug for lions and other game. Its opening is camouflaged with a covering so that the quarry falls into it. (3) The hadith is found in *al-Musnad* (al-Maārif ed.), 2/24, 25, 236, and 327–328. Its wording at 2/24 is as follows: “Abū Saīd narrated to us: Isrāīl narrated to us: Simāk narrated to us, from Hanash, from Alī, who said: ‘The Messenger of Allah—may Allah bless him and grant him peace—sent me to Yemen. We came upon some people who had made a pit for trapping a lion. As they were jostling around it, one man fell in and grabbed hold of another, who then grabbed another, until four men had fallen into the pit. The lion mauled them. A man stepped forward with a spear and killed it, but all four men died of their wounds. The first man’s next of kin then confronted the others, and they drew their weapons to fight. Alī came to them immediately afterward and said, “Do you intend to fight while the Messenger of Allah—may Allah bless him and grant him peace—is still alive? I shall give you a ruling: if you accept it, it shall stand; otherwise, some of you must restrain the others until you go to the Prophet—may Allah bless him and grant him peace—and he will judge between you. Whoever transgresses after that shall have no claim. Collect from the tribes of those who dug the pit one-quarter of the *diya* (blood money), one-third of it, one-half of it, and a full *diya*. The first man shall receive one-quarter, because he died under the weight of those above him; the second shall receive one-third of the *diya*, and the third one-half.” They refused to accept the ruling. They therefore went to the Prophet—may Allah bless him and grant him peace—while he was at the Station of Abraham and recounted the incident to him. He said, “I shall judge between you,” and sat with his knees drawn up. One of the men then said, “Alī has already judged between us.” They recounted the incident to him, and the Messenger of Allah—may Allah bless him and grant him peace—approved Alī’s judgment.’” Shaykh Ahmad Shākir—may Allah have mercy on him—authenticated the hadith’s chain in each of these four occurrences. In his commentary, he states: “The expression *alā tafīati dhālika* means ‘immediately thereafter.’” He also states: “The hadith is found in *Majma al-Zawāid*, 6/287.”
