Minhaj as-SunnahIbn Taimiya

None of those granted amnesty were Emigrants. Rather, the Prophet—may Allah bless him and grant him peace—said:

“There is no emigration after the Conquest, but there remain jihad and sincere intention.” (1)

When (2) Safwān ibn Umayya came as an emigrant, the Prophet—may Allah bless him and grant him peace—ordered him [to return] (3) to Mecca. When al-Abbās brought him a man (4) to pledge allegiance to him on the basis of emigration and adjured him to accept it, he took the man by the hand and said, “[I] (5) have fulfilled my uncle’s oath, but there is no emigration after the Conquest.”

Al-Abbās had left Mecca for Medina before the Prophet—may Allah bless him and grant him peace—arrived [there] (6) in the year of the Conquest, and he met him on the road. Thus, those granted amnesty did not reside in Medina. If he did expel him, he expelled him from Mecca, not Medina. Had he expelled him from Medina, he would have sent him to Mecca.

Many scholars have challenged the claim that he was exiled, as noted above, and have said that he left of his own accord.

Expulsion means banishment. The Sunnah prescribes banishment for the fornicator and for effeminate men, and such offenders were disciplined by banishment. Even if the Prophet—may Allah bless him and grant him peace—disciplined a man by banishing him, it does not follow that he must remain banished forever. No such punishment is known for any sin, nor does the Shariah prescribe, for any sin, that its perpetrator should remain
