Rather, those properties must be spent on works pleasing to Allah and His Messenger. Likewise, [Abū Bakr] al-Siddīq [—may Allah be pleased with him—] said (1).
As for what might be thought to have been his personal property—such as property bequeathed to him (2) by [Mukhayrīq] (3), and his share from Khaybar (4)—one may either say that it was subject to the same ruling as the aforementioned wealth, or that it was his property, but Allah’s ruling concerning him was that he take from it what he needed, while anything beyond that would be charity and would not be inherited.
This is stated in the authentic hadith narrated by Abū Hurayra—may Allah be pleased with him—that the Prophet—may Allah bless him and grant him peace—said:
(* “My heirs shall not divide (5) even a dinar or a dirham. Whatever I leave after the maintenance (6) of my wives and the expenses of my administrator is charity.” (7). In the two Sahih collections, Abū Hurayra—may Allah be pleased with him—narrated that the Prophet—may Allah bless him and grant him peace—said *) (8): “No inheritance is taken from us; whatever
(1) A: “For that reason Abū Bakr al-Siddīq—may Allah be pleased with him—said”; B: “Abū Bakr al-Siddīq—may Allah be pleased with him—likewise did”; N, M, H, W, R, and S: “Likewise, al-Siddīq said.”
(2) “Such as property bequeathed to him…” This wording occurs only in S. All other manuscripts read: “such as what was bequeathed to him…”
(3) “Mukhayrīq” is absent from N, M, and W. He was Mukhayrīq al-Nadrī, an Israelite from Banū al-Nadīr. Ibn Hajar stated in al-Isāba, 3/373: “Al-Wāqidī related that he embraced Islam and was martyred at Uhud… He had bequeathed his properties to the Prophet—may Allah bless him and grant him peace—which comprised seven orchards… The Prophet—may Allah bless him and grant him peace—then designated them as charity.”
(4) N: “Hunayn.”
(5) A and B: “shall not divide.”
(6) A and B: “after the expenses of.”
