and just as, in the year of Khaybar, he ordered them to smash the cooking pots in which (1) donkey meat had been cooked, then permitted them to pour away (2) their contents (3), thereby demonstrating that both courses were permissible.

Likewise, when wine was forbidden, he ordered that its containers be slit open and its jars smashed (4).

Similarly, ʿUmar ibn al-Khattāb and ʿAlī ibn Abī Tālib—may Allah be pleased with them both—(5) ordered that the place where wine was sold be burned down.

As for those among the followers of Abū Hanīfa and al-Shāfiʿī, as well as Ahmad, who did not permit this—in

(1) The word “was” is omitted from (A), (B), and (W). (2) (H), (R), and (S) read: “by pouring away.” (3) The hadith of Salama ibn al-Akwaʿ—may Allah be pleased with him—is recorded in al-Bukhārī, 5/130–131 (Book of Military Expeditions, chapter “The Battle of Khaybar”). It is part of a lengthy hadith concerning the Battle of Khaybar, which states: “The Prophet—may Allah bless him and grant him peace—asked, ‘What are these fires? What are you cooking over them?’ They replied, ‘Meat.’ He asked, ‘What kind of meat?’ They replied, ‘Meat from domesticated donkeys.’ The Prophet—may Allah bless him and grant him peace—said, ‘Pour away their contents and break the pots.’ A man asked, ‘Or may we pour away their contents and wash them?’ He replied, ‘Or do that.’” The hadith is also recorded in al-Bukhārī, 3/136 (Book of Wrongdoing, chapter “Should Jars Containing Wine Be Smashed?”); Muslim, 3/1427–1429 (Book of Jihad and Military Expeditions, chapter “The Battle of Khaybar”); and *Sunan Ibn Mājah*, 2/1065–1066 (Book of Slaughtered Animals, chapter “The Meat of Wild Donkeys”). (4) In *Sunan al-Tirmidhī*, 2/379–380 (Book of Sales, chapter “Reports Concerning the Sale of Wine and Its Prohibition”), Anas narrates from Abū Talha that he said: “O Prophet of Allah, I purchased wine for orphans under my guardianship.” He replied, “Pour away the wine and break the jars.” Al-Tirmidhī said: “Reports on this subject have also been narrated from Jābir, ʿĀʾisha, Abū Saʿīd, Ibn Masʿūd, Ibn ʿUmar, and Anas. Concerning Abū Talha’s hadith, al-Thawrī narrated it from al-Suddī, from Yahyā ibn ʿAbbād, from Anas, according to whom Abū Talha had the wine in his possession. This is more authentic than Layth’s narration.” Al-Albānī graded the hadith weak in *Daʿīf al-Jāmiʿ al-Saghīr*, 1/227. See also al-Bukhārī, 7/106–107 (Book of Drinks, chapter “The Prophet’s Permission—may Allah bless him and grant him peace—to Use Vessels and Containers after He Had Prohibited Them”). (5) The phrase “may Allah be pleased with them both” is omitted from (N), (M), and (W).
