514 — Ubayd Allah ibn Muhammad ibn Ahmad informed us: Ahmad ibn Kamil related to us, saying: I heard Abu Ja‘far Muhammad ibn Jarir al-Tabari say on countless occasions:

“Whoever says that the Quran is created, believing this to be so, is a disbeliever whose life and property are forfeit. His Muslim heirs do not inherit from him. He is to be asked to repent; if he repents, [he is spared], but if not, he is to be beheaded.”

I said to him, “From whom [do you relate the ruling] that his Muslim heirs do not inherit from him?” ⦗354⦘ He replied, “From Yahya al-Qattan and Abd al-Rahman ibn Mahdi.”

It was said to Judge Ibn Kamil, “Then to whom does his property belong?” He replied, “It becomes fay’ for the Muslims.”
