  • (2-2-4) The Ruling on the Duhā Prayer:

The preceding hadiths and others like them demonstrate that praying at the time of Duhā is good and beloved. (1)

Some of them indicate that it is prescribed to perform it regularly. (2)

Nothing has been authentically established to indicate that it is obligatory.

  • (3-2-4) The Time of the Duhā Prayer:

The time for the Duhā Prayer begins at sunrise and continues until the sun passes its zenith.

Its best time is when the sun’s heat intensifies.

The evidence for this is as follows:

As for its earliest time, this is indicated by the aforementioned hadith of Abū al-Dardā and Abū Dharr. The relevant passage is: “Perform four rakʿahs for Me at the beginning of the day.”

(1) *Majmū al-Fatāwā* (22/284). (2) This is the apparent meaning of the preceding hadiths. *Nayl al-Awtār* (3/77). As for Shaykh Ibn Taymiyya—may Allah have mercy on him—after establishing that scholars knowledgeable about the Prophet’s Sunnah agree that the Prophet (peace and blessings be upon him) did not regularly perform the Duhā Prayer, and after affirming that it is recommended, he said: “One question remains: Is it preferable to perform it regularly, or is it preferable not to do so, following the example of the Prophet (peace and blessings be upon him)? Scholars have differed over this. The view that appears most appropriate is that whoever regularly performs the night prayer has no need to perform the Duhā Prayer regularly, as was the case with the Prophet (peace and blessings be upon him); but for whoever sleeps through the night prayer, the Duhā Prayer serves as a substitute for it.” End quote. *Majmū al-Fatāwā* (22/284). I say: However, the apparent meaning of the texts is that regular observance is recommended without qualification. The Messenger of Allah (peace and blessings be upon him) would sometimes refrain from a deed that he wished to perform out of fear that people would adopt it and it would consequently be made obligatory upon them. This, then, explains why he did not perform it regularly, while the texts retain their unrestricted meaning. Lady Aisha—may Allah be pleased with her—alluded to this point. See *Jāmi al-Usūl* (6/108–109).
