what I have already presented to you (1), where I established that the Prophet’s statement, peace and blessings be upon him, “Make witr the last of your prayer at night,” does not indicate obligation. Rather, its purpose is that a Muslim should not omit witr from his night prayer, as the Prophet, peace and blessings be upon him, said: “The night prayer is performed two rakʿahs at a time. When you wish to conclude, pray one rakʿah, making what you have already prayed odd-numbered.” (2)
Thus, his statement, “Pray one rakʿah, making what you have already prayed odd-numbered,” indicates that the Muslim is being instructed not to leave his night prayer as an even number of rakʿahs without witr. And Allah knows best. (3)
(1) See the discussion above under no. 7/4–3.
(2) Its sources were cited previously at the same place referenced in the preceding note.
(3) One question remains: If a follower has already performed witr at the beginning of the night and then joins the imam in congregational prayer, should he refrain from performing witr with him, thereby missing the virtue mentioned in the marfū' hadith of Abū Dharr: “Whoever prays with the imam until he finishes will have a full night of prayer recorded for him”? (Its sources were cited shortly above.)
The answer, as appears correct—and Allah knows best—is that the follower should pray the imam’s witr rak'ah with the intention of making his own prayer even-numbered. When the imam concludes the rak'ah with the salām, he should stand and perform a second rak'ah. He will thereby have remained with the imam until the imam finished while also avoiding the performance of two witr prayers in one night. And Allah knows best.
The difference between the intentions of the follower and the imam does not invalidate the prayer. Allah grants success.
