a dispute over the matter, and that one faction claimed there was an explicit designation for al-ʿAbbās, while another claimed it was for ʿUmar.
He said: They are unanimously agreed that whoever knowingly opposes a certain, verified consensus is a disbeliever. (1)
I say: On this point there is well-known disagreement among the jurists.
He said: They are unanimously agreed that if a mouse—male or female—falls into clarified butter and dies while the butter is in liquid form, it is not to be eaten. (2)
I say: This, too, is the subject of a recognized dispute. One school holds that the mouse and whatever is close to it are discarded and the rest may be eaten, whether the butter is solid or liquid.
Al-Bukhārī said in his Ṣaḥīḥ, “Chapter: When a mouse falls into solidified or melted clarified butter”:
Al-Humaydī narrated to us; Sufyān narrated to us; al-Zuhri narrated to us; ʿUbayd Allah ibn ʿUtba informed me that he heard Ibn ʿAbbās relate from Maymūna that a mouse fell into clarified butter and died. The Prophet—peace and blessings be upon him—was asked about it and said, “Remove it and whatever is around it, then eat (the remainder).”
It was said to Sufyān, “But Maʿmar reports it from al-Zuhri, from Saʿīd ibn al-Musayyab, from Abū Hurayra.” He replied, “I heard al-Zuhri relate it from ʿUbayd Allah, from Ibn ʿAbbās, from Maymūna, from the Prophet—peace and blessings be upon him—and I have heard it from him many times.” (3)
ʿAbd al-Razzaq narrated to us (4)—ʿAbd Allah narrated to us, from Yūnus, from al-Zuhri—concerning an animal that dies in oil or clarified butter, whether the butter is solid or otherwise, whether it is a mouse or something else. He said: “It has reached us that the Messenger of Allah—peace and blessings be upon him—ordered, when a mouse died in clarified butter, that whatever was near it be removed, and then the rest was eaten.” This comes from the hadith of ʿUbayd Allah ibn ʿAbd Allah.
