A grandson does not inherit when a son is present
Question: Two brothers—one of whom has died, leaving behind two sons—have lost their grandmother. Do the sons of the deceased brother receive any share of what their grandmother left in property and cash, or does it all go to their uncle alone?
Answer: Grandsons through a son do not inherit if a son who is nearer to the deceased is alive. Therefore, whenever the deceased has a surviving son together with grandsons through another son, the estate belongs exclusively to that surviving son. Likewise, if there is a higher-level grandson (a son’s son) alongside a lower-level grandson (a son’s son’s son), the inheritance goes to the higher grandson, as he is closer to the deceased.
