1679 – ʿAbd Allah narrated to us; Shayban ibn Abi Shaybah narrated to us; Muhammad ibn Rashid narrated to us, from Sulayman ibn Musa, who related that news reached him that a group of Bedouins brought a case before ʿUmar ibn ʿAbd al-ʿAziz against some members of the Banu Marwan concerning a tract of land that had originally belonged to the Bedouins—they had reclaimed and cultivated it. Al-Walid ibn ʿAbd al-Malik had later seized that land and given it to certain members of his household. ʿUmar ibn ʿAbd al-ʿAziz ruled, saying, “The Messenger of Allah ﷺ said: ‘The lands are Allah’s lands and the servants are Allah’s servants; whoever revives dead land, it becomes his.’” He therefore returned the property to the Bedouins.
