- What Is Permissible with a Menstruating Wife:
A husband may enjoy with his menstruating wife anything short of vaginal intercourse, and this is supported by several hadiths.
- The first is the statement of the Messenger of Allah ﷺ: “…Do anything you wish except intercourse.” 1
and by Ibn al-Mulqin. Summarized in Khulasat al-Badr al-Munir. Imam Ahmad had already classified the hadith as sound and adopted it as his own position. Abu Dawud reports in al-Masail, p. 26: “I heard Ahmad being asked about a man who goes to his wife while she is menstruating. He replied, ‘How excellent is the hadith of Abd al-Hamid on this!’ I said, ‘You mean this very hadith?’ He said, ‘Yes; the matter only requires an expiation.’ [I asked:] ‘One dinar or half a dinar?’ He replied, ‘Whichever he chooses.’” A number of other early scholars likewise acted on this hadith; their names are listed—and the report further authenticated—by al-Shawkani in Nayl al-Awtar 1/244. (1) That is, sexual intercourse. Al-Azhari comments: =
