This is further corroborated by the hadith of ʿA’isha, who said, “The Messenger of Allah, peace and blessings be upon him, would lie down to sleep while in a state of major ritual impurity without even touching water [until he later rose and performed the ritual bath].” 1
(2) He then adds: “Its basic wording occurs in the two Sahihs, except for the phrase: ‘if he wishes.’”
I say: In fact, Sahih Muslim also contains this very addition, as documented earlier (p. 114). It is an explicit proof that performing wudu (minor ablution) before sleeping in a state of janabah is not obligatory, contrary to the Zahiri school.
(1) The report is narrated by Ibn Abi Shaybah 1/45/1; by the compilers of the Sunan except al-Nasai—though he cites it in al-Asharah, pp. 79–80; by al-Tahawi, al-Tayalisi, and Ahmad; by al-Baghawi in Hadith Ali ibn al-Jad 9/85/1 and 11/114/2; by Abu Ya‘la in his Musnad 224/2; and by al-Bayhaqi and al-Hakim, both of whom declared it sahih, a judgment that is sound, as I have shown in Sahih Abi Dawud, no. 223. ‘Afif al-Din Abu al-Ma‘ali also includes it in Sittin Hadithan, no. 6, with the wording: “If he wakes up toward the end of the night and still has need of his family, he may return to them and then perform ghusl (major ritual bath).” Its chain of transmission contains Abu Hanifah (may Allah have mercy on him).
Ibn Abi Shaybah likewise reports with a sound chain from Ibn Abbas: “If a man has intercourse and then wishes to do so again, there is no harm in delaying the ghusl.”
