“So heed my counsel concerning women: treat them well, for they are like captives in your care; you hold no power over them beyond this—unless they commit a manifest act of indecency,1 and if they do, then withdraw from their beds and discipline them without inflicting injury. Should they obey you, do not seek any way against them. Indeed, you have rights over your wives and your wives have rights over you. Your right over them is that they must not allow anyone you dislike to use your bedding, nor admit into your homes anyone you dislike. Their right over you is that you show kindness to them with regard to their clothing and their food.2"
(1) That is: something manifest. Al-Nihaya explains: “Every ugly trait, whether in word or deed, is a fahisha (indecency).” Accordingly, al-Sindi remarks in his marginal notes: “What is meant here is nushuz (marital recalcitrance), bad temper, and harming the husband or his family by word or hand, not zina (adultery), because the phrase ‘a non-severe beating’ would not be appropriate for adultery. This reading also accords with the Qur’anic statement *wa-llati takhafuna nushuzahunna* (4:34); the hadith therefore functions as an explanation of that verse, and the beating intended is moderate, not harsh.”
(2) Related by al-Tirmidhi, 2/204, who graded it “hasan sahih,” and by Ibn Majah, 1/568–569, on the authority of Amr b.
