Al-KāfīIbn Abd al-Barr

Chapter: A Comprehensive Treatment of Testimonies

  1. The testimony of a party that is set upon by highwaymen and robbed is admissible against the thieves, provided the witnesses are upright.
  2. From within that group, only the testimony of two men is accepted on behalf of another person who was robbed along with them; their testimony is not accepted for their own claims.
  3. Should two other upright men from the same company testify in favor of the first pair, that testimony is received.
  4. The same ruling applies, in their view, to people who are shipwrecked at sea: they may bear witness for one another.
  5. The testimony of such individuals—and of travelers in comparable circumstances—may be admitted on the basis of recognized features and outward appearance, for these are cases of necessity.
  6. Whoever possesses testimony in favor of someone who is unaware of it must inform him.
