Chapter: A comprehensive statement on pre-emption and the practical rules governing it
The guardian appointed by the deceased may exercise the right of pre-emption on behalf of the minors under his care as well as on behalf of adult spendthrifts who are legally incompetent. If such an incompetent person—or a minor while still underage—personally claims pre-emption, his claim is admitted once he displays sound judgment, for his action is deemed beneficial. This remains true even if he had previously concluded a settlement over a case of intentional homicide.
