If, however, the owner refuses both to take the garment and to reimburse the usurper for the added value of the dye, and the usurper in turn refuses to hand over its price, the garment is to be sold. From the sale proceeds the owner receives its undyed value, while any surplus goes to the usurper in compensation for his dyeing.
