suffer loss in either of the two lots, that loss would fall on them both.
If they happened to join in an invalid partnership over two separate items and then parted ways, the earlier valuations are disregarded; each partner looks only to the price for which his own merchandise was actually sold, and they divide the profit according to those sale prices.
Likewise, if one of them contributed more capital than the other yet stipulated that the profit be split equally, such a condition is impermissible and must be set aside until profit and loss are allocated in proportion to the amount each has invested. The partner who supplied the lesser capital is entitled to the going wage calculated on half of the excess of his companion’s capital, provided the two were equal in the work they performed.
