Chapter: Zakāt on Musāqāh

When the orchard’s produce reaches five wasqs or more, zakāt becomes obligatory on the entire yield, whether or not either partner’s individual share reaches the nisāb. Each of the two may lawfully stipulate that the zakāt on his share be assumed by the other, and this remains valid whether the orchard yields a full nisāb or falls short of it, for every share is a specified, known portion. It is likewise permissible to enter into a musāqāh agreement with a dhimmī, or to employ him under any other form of lease or wage-based work.
