However, if the calamity strikes a specific section of the palms and other trees, the musāqāh is annulled with respect to that section alone, leaving the rest untouched. If the damage amounts to less than one-third of the orchard, the musāqāh remains sound and binding. Likewise, should the well collapse, the musāqāh is dissolved—unless the worker chooses to spend from his own funds to repair the well and continue under the same contract. In that event the orchard owner may hold, as collateral, an amount of fruit equal to the outlay; that is permissible.
