Al-KāfīIbn Abd al-Barr

Issue: If someone sows seed in his own land and a flood then carries that seed away and deposits it in another person’s land where it takes root and grows, the resulting crop belongs to the owner of the land in which it sprouted, and the seed-owner has no claim against him. Some jurists, however, maintain that the crop belongs to the seed-owner, who must in turn pay a rent equivalent to the customary hire of that land; in my view, this latter opinion is the sounder and more consistent with qiyās (analogical reasoning).
