Al-KāfīIbn Abd al-Barr

Chapter on Leasing Land and on Magharasa (tree-planting partnerships)

According to Mālik and the vast majority of his disciples, it is impermissible to lease land in return for produce—whether that produce grows on that very land or elsewhere—be it a food crop or something else, such as safflower, saffron, cotton, or flax. Likewise, it may not be leased for any sort of grain or edible seasoning, regardless of whether the land is capable of producing it. They do, however, allow the land to be leased for whatever God causes to appear in it of naturally occurring substances over which human beings have no control, such as gold, silver, lead, tin, iron, copper, antimony, orpiment, firewood, non-fruit-bearing trees, reeds, and timber.
