Al-KāfīIbn Abd al-Barr

Chapter: Hiring slaves, other wage-earners, and herdsmen.

If a man hires a slave to serve him for one month on condition that, should the slave fall ill, the missed days will be made up at some other time, the contract is invalid, because the replacement days are not the same as the original ones.

Whoever hires someone to pasture sheep, cattle, or camels must set a definite term—a year, a month, or any other clearly specified period—and agree on a known wage. He must not hire him to tend individually designated sheep, nor to attend to one specific mount, unless it is expressly stipulated that, should any of the sheep die or any of the livestock perish
