Al-KāfīIbn Abd al-Barr

Mālik, his associates, and other jurists have laid down on the matter—their various statements and legal opinions—within the book al-Tamhīd, praise be to Allah. In sum, Mālik’s position is that the sale contract itself stands as valid; however, the goods are to be taken from the intercepting buyer and presented to the regular merchants in the town’s market. If those merchants wish to purchase the goods at the same price, they have the strongest claim to them; if they choose not to, the liability rests with the buyer who intercepted the merchandise. This is the soundest narration from Mālik and, God willing, the view closest to the truth. Allah alone grants success.
