Chapter: Mutual rescission (iqāla) in salam and other contracts
If the rescission is effected for the original capital—returned in exactly the same quality and weight or the same measure and quality, or, where the price was merchandise, in that very merchandise or its equivalent—and no deferment is involved, it constitutes a mere annulment of the sale and is permissible in every contract.
Should any of these conditions be breached, or any delay enter into the arrangement, the transaction becomes a new sale, subject to the same rules that make ordinary sales lawful or unlawful.
Mālik holds that mutual rescission is allowed for every salam contract, whether the subject-matter is food or something else, provided you take back, in that very session and before the parties disperse, either your original capital itself or its equivalent—your gold or your silver in the same coinage.
