they part company. If taking possession is postponed, the transaction is invalid and is treated as kālīʾ bi-kālīʾ (a debt for a debt).

It is permissible to resell all of that to the party to whom the salam was made, with respect to any type of goods, provided that what is now being sold to him differs from the capital first paid, and that delivery is immediate rather than deferred; for if it is deferred, the exchange again becomes kālīʾ bi-kālīʾ.

It is likewise permissible for him to sell it back to the original seller for the same description, measure, and weight stipulated in the salam, or for something less in quantity or inferior in quality, whether at the due date, before it, or after it.

If the capital advanced was gold, he may sell it back to him for an equal amount of gold, or for a lesser weight or inferior quality; he may not, however, take from him anything heavier or of superior quality in gold—and the same rule applies to silver.

If the capital advanced was merchandise for merchandise, he may sell it to him, before its term or afterward, for the same merchandise he first advanced or for something inferior in quality, or for a lesser weight, volume, or number. He must take delivery on the spot and not defer it, as was explained in the chapter on selling goods for goods, whether for cash or on credit. He may not take from him a better quality, nor anything in greater number, weight, or measure, whether immediate or deferred; nor may he take gold in place of silver, or silver in place of gold.

Anyone who advanced gold in a salam contract for merchandise may not sell it back to his seller, before taking possession, for any amount of silver; likewise, if the original capital was silver, he may not sell it back to him, before taking possession, for any silver; and if the capital was silver, he may not sell it back, before taking possession, for any gold.
