Chapter on Muhaqala and Mukhabara
Muhaqala and mukhabara are not permissible, for the Messenger of Allah ﷺ forbade them both.
Muhaqala has two distinct forms:
- The first is analogous to muzabana: purchasing grain that has already hardened on the stalk with a measured quantity of the same grain.
- The second is leasing land in return for a portion of whatever it produces of crops that, after human preparation, become edible or drinkable, whether as food or as a condiment.
Such is the meaning of muhaqala in the well-known (mashhūr) view of the Mālikī school, and it is also the position of Ibn al-Qāsim. We have already recorded the differences among Mālik’s disciples and the other scholars on this matter—as well as on the leasing of land—in detail in the Book of Dāwūd in al-Tamhīd.
As for mukhabara, Mālik and his companions define it simply as the leasing of land, and we have clarified this fully in al-Tamhīd.
