in that same illness, he does not inherit from her unless the divorce he had issued was revocable and she dies before her ʿidda expires.
If the woman who was divorced during a husband’s terminal illness then marries other men, and every one of them divorces her while each is in his own mortal illness, she inherits from every one of them who dies, according to Mālik.
Similarly, whenever a husband has sworn an oath of divorce while sound, then breaks that oath during a terminal illness, the resulting separation is treated as a divorce in illness, and his wife inherits from him. The same rule applies to a husband who, while ill, grants his wife the option to separate (takhyīr), delegates the power of divorce to her (tamlīk), or separates from her through liʿān: whenever any of these take place during a life-threatening illness and he dies, his wife inherits as already described.
If the husband recovers from the illness in which he divorced her, then contracts another illness and dies from the second one before her waiting period is over, she does not inherit from him.
Should a Muslim, while terminally ill, divorce a Jewish or Christian wife and she embraces Islam before his death, she inherits from him—both within the ʿidda and after it—according to Mālik. The same applies if he divorces a slave-wife while ill and she is emancipated before his death; she inherits during the waiting period and afterward, provided his death results from that very illness.
If a man, while healthy, pronounces one revocable divorce, then during her ʿidda—now being ill—renders it irrevocable, the wife inherits only so long as she remains in her waiting period; if he dies after the ʿidda has ended, she no longer inherits. A second opinion maintains that she still inherits after the ʿidda, because he made the divorce irrevocable during his illness, thereby establishing her entitlement, since she would have inherited had he died while she was still observing her waiting period. Some scholars of Madinah, however, hold that a woman who has been irrevocably divorced inherits neither from an ill husband nor from one who is healthy. Allah alone grants success.
