Yet some have argued that, with regard to the stone and the wall, the speaker was merely giving voice to remorse, and that the divorce would therefore be binding—but the first opinion remains the sounder. Likewise, if a man says, “You are divorced if you do such-and-such—unless Allah wills,” the divorce still takes effect and the exception does not help him. It has nonetheless been reported that he retains a way out here, provided he intended the proviso to apply to the act itself and not to the divorce.
