Al-KāfīIbn Abd al-Barr

This is the view most commonly attributed to Mālik. Yet another report from him holds that a divorce becomes binding whenever a man merely intends it in his heart, just as a person would fall into disbelief by inward conviction even without uttering it aloud. Nevertheless, the first opinion is stronger both in rational analysis and in the light of transmitted evidence, for the Messenger of Allah ﷺ said, “Allah has excused my community for the whisperings of their souls so long as they neither voice them with the tongue nor act upon them with the hand.”
