Chapter: The defects that justify annulment of the marriage contract when they are found in either spouse and the other seeks separation on that account.
If a man discovers that his wife is afflicted with junūn (insanity), jadhām (leprosy), baraṣ (vitiligo), or with any impediment to intercourse—such as qarn (an imperforate vagina), ratq (vaginal occlusion), or ifḍāʾ (a perineal fistula in which the two passages are merged)—and he therefore wishes to part from her, he may have the marriage dissolved by judicial order. If no intercourse has taken place, she is entitled to nothing; but if he learns of the defect only after consummation, she receives the full dower that was stipulated in consideration of the intimacy he has lawfully enjoyed with her.
