Malik regarded feeding the poor as the preferable form of expiation.
Feeding means giving sixty mudd to sixty poor people, measured by the Prophet’s mudd; that is the least that satisfies the requirement. If he gives each person a mudd and a half, or even two mudd, that is praiseworthy, but he may not exceed two mudd per person according to the Prophetic measure. It is not acceptable to feed fewer than sixty persons, nor to provide for a single poor person over sixty days; the obligation is only fulfilled by feeding sixty distinct individuals. It is, however, permissible to feed those very same poor persons again in a later expiation for another day, whether that day is near or distant.
Whether he has intercourse in the private part or outside it, if ejaculation occurs the expiation becomes due; the same applies if he deliberately kisses or touches and then ejaculates. The mere meeting of the two circumcised parts—that is, penetration—requires expiation and invalidates the fast whether or not ejaculation follows. Likewise, if the glans fully enters the private part of a human being or an animal, front or back, deliberately in Ramadan, he must both make up the day and perform the expiation.
If a man has intercourse with his wife while she is willing, she too must expiate on her own behalf in addition to making up the day, and a single expiation does not suffice for them both according to Malik and his companions. If he forces her, he must undertake a complete expiation on her behalf as well as his own.
This is the distilled ruling of Malik, and the majority of his disciples adopt it. Sahnun, however, said that the husband need not expiate on her behalf, because no expiation is incumbent upon her when she has been coerced, though she must still make up the day.
A male or female slave can only expiate by fasting. Malik said: “If they should own something and use it to feed the poor, I hope that will suffice for them.”
Malik and his companions make no distinction: anyone who deliberately breaks the fast—whether by eating, drinking, or intercourse—must both make up the day and perform the expiation we have described.
